– Shipper: The customer or shipper who hires the services of a transportation company such as

– Client: Natural or legal person who hires ECRAUTOHAULER’s services.
– Vehicle: A car, van, motorcycle, or other means of transportation that Customer requests to be
transported.
– Service: Transportation of the Vehicle from a point of origin to an agreed destination.
– Contract: Agreement between ECRAUTOHAULER and the Client for the provision of the
Service.

service.
3. Licensing and Compliance
3.1 FMCSA Licensing Information
-ECR AUTO HAULER operates as an intermediary in the transportation industry, complying with
all the necessary credentials for its operation.
– We are registered as a Freight Broker with the Federal Motor Carrier Safety Administration
(FMCSA), with the following identification numbers:

transport shipments with carriers (Carriers) who offer transportation services. Our responsibilities
include:
– Coordinate shipments and ensure carriers are suitable for customer needs.
– Provide a platform where customers can compare fares and transportation services.
– Facilitate fluid and transparent communication between the parties.
-Limitations:
to. ECR AUTO HAULER is not a carrier and is not directly involved in the transportation of
shipments.
b. We do not guarantee the performance or conduct of carriers, although we work with trusted
entities.
c. Contractual responsibility for carriage lies directly between the customer (Shipper) and the
carrier (Carrier), regardless of any agreement with ECR AUTO HAULER.
Conclusion:
ECR AUTO HAULER operates as a reliable intermediary and in compliance with all FMCSA
regulations. Our role is to facilitate the connection between customers and carriers, but we do not
assume direct responsibility for the transportation of shipments.
4. Prohibition of Rebrokering
– Definition: Rebrokering occurs when a carrier transfers responsibility for the transportation of a
shipment to another carrier instead of fulfilling the contracted service.
– Prohibition: Carriers hired through ECRAUTOHAULER are strictly prohibited from Rebrokering
any shipment obtained on the platform.

– Immediate removal from the platform.
– Cancellation of payment for the service.
– Possible legal actions.
4.1 Fraud Prevention and Legal Measures- Integrity and Transparency: ECRAUTOHAULER requires carriers to act with honesty and
professionalism.
– Prohibited Practices:
– Falsification of information.
– Misleading representation of capabilities.
– Any fraudulent practices.
-Aftermath:
– Immediate termination of access to the platform.
– Report to legal and regulatory authorities.
– Legal action by ECRAUTOHAULER and affected customers.
4.2 Commitment to Quality Service
– Responsibilities of Carriers:
a. Transport shipments safely, on time, and efficiently.
b. Maintain professional and courteous communication with customers (Shippers).
c. Maintain transport equipment (trucks, trailers, etc.) in optimal condition.
d. Comply with all applicable legal, environmental, and safety regulations.
– Consequences of Non-Compliance:
– Sanctions, including permanent expulsion from the platform.

quality of service. Failure to comply with these rules may result in removal from the platform,
cancellation of payments, and legal action.
5. Scope of Service
5.1 Description of the Services Offered
ECR AUTO HAULER offers a centralized platform designed to simplify the shipping process for
both Shippers and Carriers in the United States. Our services include:
– Coordination: Connecting customers with suitable carriers based on their specific transportation
needs.
– Rate Comparison: Allow customers to compare prices from different carriers to get the best
option.- Bookings: Facilitate the booking of carriers directly through our platform.
– Communication Tools: Ensure real-time communication between customers and carriers,
ensuring transparency and efficiency.
Our goal is to simplify the transportation process for customers and provide carriers with business
opportunities.
5.2 Online Reservations and Quotation Service.
ECR AUTO HAULER offers a service available 24 hours a day, 7 days a week. Customers can:
– Request quotes and make reservations at any time.
– Access to an immediate quote service for urgent needs.
In addition, our support team is available from Monday to Friday, from 8:00 a.m. to 5:00 p.m.
(CST), to resolve doubts or problems during the transportation process.
5.3 Instant Transportation Quote
To streamline the logistics process, ECR AUTO HAULER offers an **Instant Quote** feature.
Customers can receive real-time price quotes by entering their shipment details. This tool is
designed to:
– Provide fast and accurate options.
– Help customers make informed decisions without unnecessary delays.
5.4 Vehicle Detail Requirements
To ensure an accurate quote and proper carrier assignment, customers should provide detailed
information about the vehicle to be transported, including:
– Type and model of the vehicle.
– Dimensions and weight.
– Condition (new, used, non-operational, etc.).
– Special requirements or handling precautions.

The Client undertakes to:
– Provide accurate and complete information about the Vehicle, including make, model, year,
dimensions, and current condition.
– Ensure that the Vehicle is in a suitable condition to be transported (e.g., no leakage of hazardous
fluids).
– Remove personal belongings and non-fixed accessories from the Vehicle prior to transport.
– Pay the full cost of the Service on the agreed terms.
7. Fees and Payments
– Service fees will be calculated based on distance, type of Vehicle and other relevant factors.
– Payment can be made using [accepted payment methods, such as credit card, bank transfer,
etc.].
– ECRAUTOHAULER reserves the right to hold the Vehicle until full payment is received.
7.1 Fees and method of payment.
-Cost of the service: The cost of the service will depend on the distance specifications of the
vehicle as well as the type of service selected by the customer
-Payment method: Payment must be made as follows: – $250 initial deposit to secure your space
in the trailer, the rest of the money will be paid at the time of delivery to the driver as COD payment.
(Cash On Delivery) Payment deadline: Payment of the $250 deposit will be made at the time of
making the contract and the remaining payment will be made immediately upon delivery of the
vehicle. In case of non-payment, THE CARRIER may retain the vehicle until the total amount
owed is covered.
8. Seguro
– The Client must verify that their own insurance covers any eventuality not included in the
ECRAUTOHAULER policy.
-Exclusions
Please note that the insurances belonging to THE CARRIER will only cover damage caused to
the car at the time of pick-up, transfer and delivery, ECR AUTO HAULER and the CARRIER
assigned for the transfer of your vehicle are not responsible for the loss of any personal object or
removable accessory inside the vehicle. THE CARRIER is responsible for any damage caused in
the transfer so the CLIENT must claim only THE CARRIER responsible for the transfer of his car.
ECR AUTO HAULER will ensure that CARRIERS comply with all requirements and all
documentation required by the FMCSA to perform the operations and service of transportation of
vehicles within the territory of the United States of America. THE CLIENT acknowledges that it is
their responsibility to verify that their own insurance covers any eventuality not included in THE
CARRIER’s policy.
9. Limitation of Liability
9.1 Limitations of ECR AUTO HAULER’s Liabilities
ECR AUTO HAULER acts as a facilitator, connecting Customers (Shippers) with Carriers. Our
role is limited to providing the platform and associated tools to facilitate this connection. Therefore:
a) Role of the Platform:
– Although we verify and evaluate Carriers, ECR AUTO HAULER does not directly handle,
manage, or supervise the transportation of vehicles.
– Our responsibility is limited to ensuring that the platform works properly and transparently.
b) Disputes between the Parties:
– In the event of conflicts between Customers and Carriers, our role will be mainly advisory. We
can mediate and offer guidance, but the final resolution is the responsibility of the parties involved.
c) Actions of Third Parties:
– ECR AUTO HAULER is not responsible for the actions, omissions, or conduct of third parties
related to the use of the platform.
d) Service Interruptions:
– Although we strive to ensure uninterrupted service, we cannot ensure continuous and errorfree operation. We will not be liable for any loss or inconvenience arising from interruptions of
service.
9.2 Damage to the Vehicle
Damage during transportation is an unfortunate event that can lead to losses and disputes. It is
essential to clarify responsibilities in these cases:
a) Liability of the Carrier:
– By accepting a shipment, the Carrier assumes responsibility for the vehicle during transit. Any
damage occurring in this period, unless it is the result of unforeseen and unavoidable
circumstances, is the responsibility of the Carrier.
b) Proof of Damages:- It is the Renter’s responsibility to inspect the vehicle upon receipt. Any damage must be
documented immediately, with photographic evidence, and reported to the Carrier and, if
necessary, to ECR AUTO HAULER.
c) Complaint Procedures:
– Each Carrier has its own claims procedures, as stipulated by its insurance providers.
Customers should familiarize themselves with these procedures and follow them.
d) Deadline for Complaints:
– Damage claims must be filed within a specific period after the delivery date. After this period,
the Carrier may not be liable. The exact period varies by Carrier and should be clarified at the
time of booking.
e) List of ECR AUTO HAULER:
– Our platform can provide support by facilitating communication between Customers and
Carriers in the event of damage. However, our role is one of advice, and the primary responsibility
for claims and resolutions lies with the Carrier and the Customer.
Conclusion
ECR AUTO HAULER strives to provide a reliable and transparent platform for vehicle
transportation. However, our liability is limited to the provision of services, and we assume no
liability for damages, disputes, or interruptions beyond our control.
10. Cancellations
On the CUSTOMER’S side: CUSTOMER may cancel the Service at least [7] days in advance to
receive a full refund within 5 business days. Cancellations less than [3] days will be charged a
$150 fee for cancellation of the service. By the CARRIER: In case of cancellation by THE
CARRIER, 100% of the payment made by THE CLIENT will be refunded.
11. Intellectual Property Rights of ECR AUTO HAULER
11.1 Ownership of Website Content
All content on the ECR AUTO HAULER platform, including text, graphics, logos, designs, and
software, is the exclusive property of ECR AUTO HAULER or its licensors. This content is
protected by international copyright, trademark, and other intellectual property laws.
a) Restricted Use:
– Users have a limited license to access and use the platform for personal purposes.
– Any unauthorized use, copying, redistribution or modification of the content, in whole or in part,
is strictly prohibited.
b) Digital Materials:
– Any digital materials, such as tutorials, guides, or e-books provided to users, remain the
property of ECR AUTO HAULER.
11.2 Unauthorized Use of the Trademark and Logo
ECR AUTO HAULER’s logo, branding, and other visual identity elements are registered
trademarks. They may not be used in connection with any product or service without the express

– Users are prohibited from reproducing, copying, selling, or exploiting the elements of the brand
for commercial purposes without written authorization.
b) Report Improper Use:

11.3 User-Generated Content
When customers or carriers submit reviews, images, or other content related to the services used
through our platform, they grant ECR AUTO HAULER certain rights:
a) Rights of Use:
– By submitting reviews, images, or other content, you grant ECR AUTO HAULER a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce,
modify, adapt, publish, translate, create derivative works from, distribute, and display such content
in any media worldwide.
b) Marketing Fines:- ECR AUTO HAULER reserves the right to use submitted content, whether reviews, images,
or other materials, for marketing or promotional activities. This includes its use on the platform,
advertising campaigns, promotional materials, or any other means that ECR AUTO HAULER
deems appropriate.
c) Attribution:
– Although ECR AUTO HAULER has the right to use user-generated content, it will always
endeavor to attribute credit to the author where possible.

This means that the vehicle is not stolen, there are no disputes over its ownership, and no third
party has unstated claims on it.
-Authorization in the Absence of Ownership: If you are not the direct owner of the vehicle, you
confirm that you have express, verifiable and legally binding authorization from the rightful owner
to enter into this agreement on your behalf.
– Accuracy of Information: All information provided about the vehicle (make, model, condition,
size, etc.) is accurate and complete. Omitting or falsifying information may result in additional
charges, delays, or legal consequences.
– Indemnification: In the event of any disputes or legal action due to misrepresentations about
ownership or authorization, you agree to indemnify and hold ECR AUTO HAULER harmless from

– Dispute Resolution: In the event of disputes, we act as mediators, although liability for
damages lies with the Carrier.
-Regulatory Compliance: We operate in compliance with federal, state, and local regulations.
-Data Protection: We respect your privacy and handle your personal data in accordance with
data protection laws.
4. Payment Methods and Prepaid Option
– Accepted Payment Methods: Cash, certified check, or money order.
– Prepaid Option: You can pay the full cost of transportation upfront to avoid payments upon
delivery.
– Additional Charges: If conditions such as a non-operational or oversized vehicle are not
declared, additional charges will apply.
– Invoice and Receipt: You will receive an itemized invoice and receipt after payment.

5. Delivery Location Settings

– Mileage Monitoring: It is recommended to write down the mileage at the time of pickup.
– Non-Operating Vehicles: If your vehicle is not running, you must inform us during booking to
make special arrangements.
7. Carrier’s Discretion on the Route
The Carrier has the power to choose the most appropriate route, considering factors such as fuel
efficiency, traffic conditions and safety.
8. No Carrier Warranty or Specific Time
– We do not guarantee the assignment of a specific Carrier or the timeliness of deliveries due to
unpredictable factors such as weather or mechanical delays.
9. Handling Non-Operational and Oversized Vehicles
– Accurate Information: It is crucial to declare if the vehicle is not working or is oversized.
– Additional Charges: Additional charges will apply if these conditions are not stated.
10. Risks of Failure to Declare Conditions
– Total Transparency: It is mandatory to declare all the conditions of the vehicle.
– Consequences: Failure to provide information can result in fines, security risks, additional
charges, and delays.
11. No Reimbursement for Rental Expenses
We do not refund vehicle rental expenses incurred due to delivery delays.
12. Prohibited Items in the Vehicle
– List of Prohibited Items: Explosives, weapons, narcotics, legal documents, jewelry, money,
live pets, plants, and any illegal items.
– Forfeiture: Any prohibited items found in the vehicle will be confiscated without compensation.13. Payment Required at Delivery
– Payment Methods: Cash, certified check or money order.
– Vehicle Hold: If payment is not made, the Carrier may hold the vehicle until any outstanding
charges are covered.
14. Damage Claim Protocol
– Immediate Inspection: Check the vehicle upon receipt and document any damage on the Bill
of Lading.
– Claims Submission: Claims must be submitted within 24 hours of delivery.

14.1 Immediate Inspection:
– Upon receipt of the vehicle, the customer must thoroughly inspect it in the presence of the
carrier’s representative.
14.2 Documentation of Damage:
– If damage is identified, it must be documented immediately on the Bill of Lading.
– Annotations must be clear, specific, and signed by both the customer and the carrier
representative.
– It is recommended to take photographs as additional evidence.
14.3 Importance of Bill of Lading:
– The signed Bill of Lading is a key document in the event of damage claims.
– If no damage is noted at the time of signing, the document serves as proof that the vehicle
was delivered in satisfactory condition, and any subsequent claims could be invalid.
15. Carrier’s Sole Liability
– Intermediary Role: ECR AUTO HAULER is not responsible for damage, theft or delays during
transportation. The responsibility lies with the Carrier.
16. Importance of Bill of Lading
– Key Document: The Bill of Lading is an essential document that details the condition of the
vehicle at the time of delivery.17. Carrier Liability Coverage
– Standard Liability: The Carrier’s liability for damage is limited to the “blue book” value of the
vehicle.
– Extended Coverage: Some carriers offer additional coverage for an extra cost.
18. Risks of Not Taking Out Additional Insurance
– Financial Loss: Without additional insurance, you assume the risk of financial loss in the event
of serious damage.
– Unpredictable Events: Accidents, natural disasters, or theft can result in significant costs.
19. General Release and Recognition
– Intermediary Role: You acknowledge that **ECR AUTO HAULER** does not physically
transport the vehicles.
– Release of Claims: You release **ECR AUTO HAULER** from any transportation-related
claims, except in cases of proven negligence.
20. Miscellaneous
